4. Orders & Payment
- Orders are not confirmed until payment (or an approved purchase order, for qualifying institutional/school accounts) is received and accepted by Tri-State Machinery,L.L.C.

- Estimated delivery dates are not guaranteed. Tri-State Machinery is not responsible for delays caused by carriers, manufacturers, or circumstances beyond our reasonable control.
6. Returns, Refunds & Cancellations
- Used equipment and special-order/custom items: sold as-is; final sale, no returns.
- Accessories, blades, and consumable parts are non-returnable
- Repair services: once labor or diagnostic work has begun, service fees are non-refundable; parts ordered specifically for a repair may be non-returnable if special-ordered.

7. Warranties & Disclaimers
- New equipment: covered by the applicable manufacturer’s warranty only (e.g., SawStop, SCM, Laguna, Oneida Air Systems). Tri-State Machinery will assist in facilitating manufacturer warranty claims but does not independently warrant new equipment beyond what the manufacturer provides.
- Used equipment: sold “AS IS, WHERE IS,” with no warranty of merchantability, fitness for a particular purpose, or condition, express or implied, except as specifically stated in writing at time of sale.
- Repair services: workmanship on repairs performed by Tri-State Machinery is warranted for [X] days agree upon from the date of service, covering labor and parts installed by us, and excludes damage resulting from misuse, lack of maintenance, or unrelated mechanical failure.
- Machinery safety: all equipment sold or serviced by Tri-State Machinery is intended for use only by trained, qualified operators in compliance with the manufacturer’s instructions and applicable OSHA and workplace safety regulations. The buyer is solely responsible for proper installation, safe operation, employee training, and compliance with all applicable laws.
8. Limitation of Liability
To the fullest extent permitted by law, Tri-State Machinery, LLC shall not be liable for any indirect, incidental, special, or consequential damages — including lost profits, lost production time, or property damage arising from the purchase, use, installation, or repair of any product or service, except where such liability cannot be excluded by law. Our total liability for any claim shall not exceed the amount paid for the specific product or service giving rise to the claim.
